That looks like a willow oak volunteer seedling that's been topped numerous times because somebody thought it was a shrub instead of a tree. Its a mess now and I'd remove it.

Agree with the Willow Oak. It's too big...wouldn't even try to move it now, you're going to have enough trouble just getting it out of the ground.
