Your tree is in danger - from being indoors. It will not survive long at all there and if your climate's too hot or dry for birch, then don't grow it, but keeping it indoors won't work either (and certainly allowing the soil to dry out won't!). Whatever the flies are, you don't want them inside either, and being outside will help them to move on (or else an insecticide might be needed - but don't assume the flies are necessarily bad for the tree itself).

Also, you might try removing the top layer of soil (or mulch, if there is any) from the pot, and replacing with fresh soil/medium. The flies are probably congregating for moisture or food or mating. As Lucy mentioned, the flies may not necessarily be bad for the tree. The presence of the flies could, however, indicate that conditions in the pot are not the best for the birch.

My guess is that the flies will move in a short while.

i took the tree outside and it gets pretty good sunlight now, the bugs are slowly going away so i think thats under controll now. My next question is how do i tell what kind of birch is it. i think its a silver birch but it looks like some type of weeping birch , if there is such a thing could you help?
