Could be aphids - not close enough to tell. If so then they aren't the problem but any green or red aphids on the underside of the leaves will be.

Or they could just be 1 of 100 varieties of tiny garden flies in which case they still pose no problems and may actually contribute to pollination.

If they are doing no visible harm to the plants then they are of no concern no matter what they may be.

I agree with DigDirt. Actually just looks like gnats which pose no harm other than being annoying. They love moist conditions. You been getting rain lately?

gsweater - No rain here, its actually very hot in SoCal. These insects do not seem to harm the plant - look more like fruit flies to me LOL
