Tree fern planted by landscape designer just over a week old dyin

We hired a landscape designer to come up with a plan and install all new plants around our house. Just a few days after planting, an Australian tree fern right in front of our house started looking unhealthy. Nearly 8 days after it was planted, it's looking bad with a lot of brown saggy fronds. I posted in the CA forum and a few folks thought it was planted too close to the house and needs moved. But I am concerned about the stress we would put on the plant if we moved it. I've read that these tree ferns resent transplant.

I've e-mailed my landscape designer and sent him photos of the tree fern, but he's been non-responsive. In this situation, should the landscape designer replace this tree with something else at his expense since it died shortly after it was planted? I looked through the contract and there's no language covering this situation when a plant dies. I've generally done my own landscaping in the past, so I don't know how this works. Thanks.
