| I am fairly certain that 'Green Envy' (like the majority of perennial and woody plant cultivars) is not propagated from seed. You can plant seeds from this cultivar, but they won't produce 'Green Envy'. Also, FWIW, this cultivar is patented, so intentional vegetative propagation (without permission from the patent holder) for any reason is illegal. |

| Your probably correct...was thinking double decker was newer and I have seen that seed for trade and sale. |

| So if the seeds don't come "true" why the heck is it "illegal" to grow them?? The seeds might not result in a plant exactly like the parent cultivar, but you might get something pretty darn close! Never know unless you try... |

| I think all the "illegal" stuff is ridiculous. All it is is nursery industry greed- if you grow that plant from seed you won't be making them money by buying at some nursery. I highly doubt you would be thrown in the slammer or sued for propagating for yourself, lol. Might be another subject if you are a nursery grower and making money off of it though... Don't worry, I for one am NOT going to rat you out to the Plant Police!! If you do I will try and smuggle you in some potting soil and seed packets in a cake...unless I get thrown in too for my "illegal" plant/seed activity! ;-D |

It's NOT illegal to grow the seeds. It's ONLY illegal to propagate the plant vegetatively (cuttings, divisions, etc). Even if the sexually-created seeds happened to produce an exact duplicate (the odds are near zero), it would not be illegal to grow them (at least if you could show that they were from seed). Another side to this is that most propagators would never do anything about a hobbyist vegetatively propagating a plant for their own use. I guess you could say it's like running a stop sign in the middle of the desert when you could see 20 miles in every direction. "All it is (,) is nursery industry greed..." Is wanting to be able to make a barely decent living greedy? Many plant patent holders make relatively little on their creation. They work long and hard hours and deserve the fruit of their labor (pun intended). Without plant patents, many of the newer plants today simply wouldn't exist. The law is mainly aimed at commercial production, but does equally apply to everyone (even the hobbyist). I'll bet many shoplifters are able to justify their actions by thinking that the stores are greedy, but that doesn't change what's right and wrong, and it doesn't make the activity legal. Most propagators only want to protect their creative-property and their means of making a living. The law was written by the legislature, not by the hard working propagators (a large number of which are hobbyist themselves). |
