Laying sod mistake?

Back in the first part of June, I put down some Fescue sod in an area in front of my yard. The area is next to the street where it was dug up for a water line. When they filled it back in, they put crushed stone on top.
Well it looked pretty bad, but I just let it go. Visitors would park there, and over the years it got to be hardpan where nothing but crabgrass and weeds would grow.
Before I laid the sod, I just tried to remove as much of the stone as I could an put about 2 ins. of topsoil down.
I watered it religiously and it looked real good until the last few days. It looks like it is dying in patches.
My question is, should I have broken up the hardpan before laying the sod?
