I'm not sure I'd agree with Cotinus. The stems and petioles are unnaturally red for that genus, even the red leaved forms. And the leaf shape not quite right either.

Can you post a photo of the tree in situ? And indicate where you are located ?

Euphorbia cotinifolia is another possibility, but to me the venation seems incorrect.

Both the Cotinus and the Euphorbia have very characteristically rounded leaves (the horticultural terminology "oval") while the sample in the photo has quite elongated, oblong or obovate shaped leaves.

I'm not at all sure what it is, but I am leaning strongly towards what it isn't :-))

I would say a shaded branch of Malosma laurina, but that's not a tree.
