I hope this is a better picture ~

This volunteer is very popular with the birds for its berries at this time (July 1). Can someone please name it and tell me if the berries are edible for humans?

Looks a bit like Deadly Nightshade to me (Atropa belladonna, Solonaceae family), I wouldn't eat the berries.

My hubby says "no" the flower isn't right -- they were small WHITE flowers --?

Yes, looks like deadly nightshade to me too. Can be very invasive

I'd pull it out! Why take the risk?

The birds love the berries and aren't dropping dead. In fact we have several of these bushes that were probably planted by birds spreading the seed. Some scrub jays live and nest in a nearby tree and are anything but sick and are pigging out on them. I think it might be a solanum but, like tomatoes, not poisonous? I'd still like to ID it. Will wait and photograph the flowers next spring.

Funnelweb has picked it -- its a nightshade.

I don't think it's Atropa. I'm pretty sure, though, that it's a Solanum, possibly Solanum americanum or Solanum ptycanthum.

The first species is toxic (although not as deadly as many other "Black Nightshades") and the second is "edible" but only "in small quantities" (whatever that means).

Just becauses birds eat something doesn't mean that humans can or should. Birds can assimilate a lot of toxins in their digestive system that mammals -- including humans -- cannot.

Bittersweet nightshade. Occurs up here also.

Too true Joe, lots of berries are important bird food but are toxic to humans. Don't pull it out if you aren't bothered by it and the birds are enjoying it.

If you have a dog or a cat you might try one (or two) of the berries in it's tucker (dinner). If they drop dead, well, I'd pull it out. If not, try one yourself! Another deadly member of the (Solinaceae) family is 'Angel's Trumpet', as I understand, banned in L.A. or Chicago (I forget) because one bite of a leaf will give an halucinogenic experience, two bites and they might bury you!
