Weed or Plant?

I recently moved into a rental home in the San Jose area of Northern California. I have pulled this plant two times now and it keeps coming back into my flower beds.I'm trying to figure out if it's a weed or plant the owner hand planted. The soil in my bed is mostly clay and sends most the time in full sun. With my daily watering this little guy has sprouted up in three places. Please help me!

Looks to me like a crop of Bind Weed. Unfortunately not one of the easier weeds to get rid of. Dig deep and don't leave any root. I have had it for a decade now.

Bittersweet Nightshade? Solanum dulcamara. Leaves can have several shapes.

Thank you for the suggestions. I'm hoping its not another form of nightshade as I also am having a battle with angels trumpets in another part of the yard. My toddler helps me with most of my gardening and these highly toxic ones cause me a bit of anxiety.
