What is the name of the beautiful bush

This bush is in my neighbors yard and the only thing he can remember about it is that he bought it at Home depot and he thinks it is a Red Velvet something. Does anyone know what this bush could be?

Looked up velvet cloak on internet and I don't think this bush could be one as the photos that I have seen have fluffy flowers. This bush doesn't change....no flowers produced just the stays the same year round.

Perhaps it is Berberis, barberry. Are there thorns on it?
the photo is quite blurry and a close up would certainly help.

It probably doesn't have flowers on it because the red smoke bushes are borderline hardy in MT. It doesn't bloom here in my part of NH, though it does grow, sometimes with a fair amount of winter damage if it doesn't have a covering of snow when it gets really cold.

Really hard to make out the features. Can you get a better picture? When you say 'stays the same year round' do you mean it is evergreen? If so it isn't either of the above suggestions.

There's nothing 'evergreen' in MT with that coloring :-) This has got to be deciduous. Barberry seems to be the most likely choice unless something like a young purpleleaf sand cherry.

Needs better eyes than mine to be sure :-)

That is what I suspected gardengal48 - I was just puzzled by the 'year round' wording. Maybe it should have been 'all growing season'.

Poss. Crimson Pygmy Barberry...depends on the sizing and how large if any thorns there are. If it has large visible thorns probably one of the normal-sized varietals of barberry (though they're not all red...)otherwise crimson pygmy is gaining in popularity over the past few years. I'm not sure on the structure of the plant though...they're not quite as "upright" in my experience...

I'd say the case for some form of Barberry is solid though.
