Ilex vomitoria (Yaupon Holly)

Looks like pyracantha to me. The berries are eaten by lots of different kinds of birds in my garden, so not poisonous. Very thorny shrub, which has small white flowers, and then gets these berries in mid summer and Fall. Grows like a weed in No California where I live. I used to cut lengths of the branches loaded with berries into the house at Christmas time, to use like holly.

I'm not sure of the ID but wanted to add that just because a bird (or other wildlife) can eat berries found on trees or shrubs, it does not mean humans can,so don't be tempted to use that as a rule of thumb.

It is not pyracantha (firethorn) berries. I just want to reiterate what calliope says- never, ever eat something just because it is edible for birds.

It's Yaupon Holly, as the first responder said. Ilex vomitoria, named such because it was believed to be a purgative - in humans at least.
All that aside, it's a great shrub for sun or shade, wet or dry conditions in the SE US.

Thanks everyone for the input I researched Yaupon Holly and it is indeed the one. I appreciate this site and everyone who responded. I'm always finding something that needs identifying, so I'm sure I'll be using this tool again. I too have been told birds can eat certain things that we definitely should not. Eating the berries was not in question, but, when you have children around you want to make them aware.

Ilex vomitoria 'Pendula'.

According to a USDA publication berries are 'not exactly edible'.

Leaves contain caffeine.
