Thanks bboy. It ended up in its current location by accident. I planted it there as a temporary location while construction was being done and when I went to move it in the Spring, realized it was in its permanent home and had grown far too large to move. LOL Although the fence behind it looks close, there is actually about 6' of clearance. The fence to the right is obviously closer...approx 3'...but it's kind of a "no man's land" section of yard that I think the neighbors would let me take over if I had to. Hoping to move the fence over...or the tree may do it for me! ha!

My 'Dawyck Purple' did the exact same thing this year. It's just firmed up in the past 3 days.

for mine, it was only the new growth, which was roughly 12" long. I notice now on yours it looks like even 2nd year branches that are showing this. Plant looks oddly etiolated, and sparse like you have it in too much shade?

How cranky are they about being transplanted at this size? Is it doable or am I likely to just kill it?

Man, that would be a project. Trees my height give me fits and I wonder why I did not just go spend a few bucks on a new one.
