Leaf growth on newly planted tree?

We bought and planted a red maple tree about 3 1/2 weeks ago. It's about 6 1/2 to 7 feet tall. When it was bought and planted it had no leaves... It did have buds on it. Since planted it has grown a bunch of leaves but only on the lower part of the tree, and all of the leaves have sprouted out of the "trunk", no new growth on any of the existing branches and no changes in the buds. What's going on?

*the attached picture was taken about a week ago, there are more leaves now, but you can see where they are growing.

Any idea what causes this though?

It was probably overwintered at the retail nursery and suffered significant desiccation/winter kill because it wasn't adequately protected.

The parts of the tree above the new leaves are dead.

You have the opportunity to let the tree grow back should you wish, though that does involve a bit more time and effort (and probably skill, to make sure it develops good form). The easier solution would be to send it back and get a new one. Assuming the damage occurred before you got it (I can imagine cases where tree damage occurred in transit), they owe you.
