actually it's about 7-8 feet from the house.. the roots are about 5-6 feet from the house..

Yes, it is too close to the house. If you look up the mature width of any tree, divide that number in half and that is at least how far away they need to be.

In addition it is not a very desirable tree (to people that know and love trees) - short lived, prone to breaking, non-native so it offers nothing to your local environment.

Take it down this year while it is small enough for you to do it yourself. Notice that it is already sprouting from the roots - that is a sign of damage (probably mower). Once you cut it down, treat the outer edge of the cut stump with herbicide and be prepared to clip any root sprouts that come up afterwards and apply a dab of herbicide to them as well.

Thats quite the surface root for a pear tree of that age.

Putting in another vote to get rid of it with a nicer, slower growing tree of columnar or oval habit.
