2 fold- what type and what's wrong?

This tree haas been in our back yard for 12 years and this spring it never got a full set of leaves and it looks like this. My daughter is doing a research paper on a river birch tree. I was kind of hoping that is what this tree was, but now I'm not so sure. Can anyone help identify not only the type of tree, but also what is wrong with it or if it can be saved?

1) Black cherry?

2) The top is dead, it's not coming back. Looks sorta' like it's planted too deeply.

I think it is a black cherry. The top is dead, you can cut that of if you want or it will fall in next storm. The rest will grow up to a new tree, with a little different branch structure.

From what I can see, for two of the three trunks the only green is all sucker growth. Is that right? Just from twig-like branches near the bottom third? If so, that was a last gasp effort at survival by the tree and I'd cut those two down completely. Depending what the health of the third trunk is like, it may need to go as well.
