Tree on property line

again tree newbie here. My neighbor has a fairly large tree that starts on his property and grow at a 45 degree angle for about 6 feet ( crossing in to my yard)and then grows straight up. In terms of volume 99 % of the tree is my yard air space. I do not know the neighbor and I have no plans to cut tree, but what are the general guidelines for cutting tree that cross property line.

If I cut to line, my neighbor has a stump

You could start by phoning your local government office.

There are distinctions between what is 'legal' and what is 'right'. If you cut the tree at the property line, it *may* be legal but if the tree dies, you may then be subject to civil litigation.

Not really a 'gardening' question....more of a legal one.

Smivies gave a great answer, but here's mine:

It depends on the laws (and maybe even local rules - HOA, etc) in YOUR area. The answer would definitely not be the same in all jurisdictions.

In MOST areas, you could trim the parts of the tree that are on your side, as you see fit, as long as it does not kill the tree.

Welcome aboard Ramsey! Have fun with one of the few places I can make tree jokes and people get them.

Is the tree over your home or where you park your classic car? That would really get me paying attention to the local regulations.

does it.. in any way.. threaten your house???

one might suspect that is the base issue.. should anything ever need be done..

and it sure wouldnt hurt to ID the tree ... as that is very important to the issue above ... an oak might sit there for another 100 years ... a poplar might fall on your house tomorrow.. if you sneeze wrong..

post a pic of the tree .. the trunk.. and a leaf.. and these guys will give you an ID ...

beyond that... as noted previously .. this is a local LEGAL issue.. not a tree issue .. and in that regard.. what they said
