Here is the bark

I looked it up in the Manual of Woody Landscape Plants. Looks like it's a red maple, it is a very common Canadian maple. In the fall it could be greenish yellow to yellow to brilliant red. Very hardy.
It has many cultivars. It depends on the shape, and growth habit.
You can look it up in the internet under the book I mentioned by Michael A. Dirr.

Is the fall color like that year after year?

Thanks Wildflower, from that info I agree, seems like a red. I plan to put maybe 4/5 Autumn Blazes across the back edge of the property next spring, so I guess these two can stay since they are slightly different.

Toronado, I can't say for sure on the year after year part, since I only bought the house 3 weeks ago, but I would guess yes, becuase this year, for the first time in a few years, we are getting alot of nice color in Michigan. Finally had enough rain throughout the summer to keep everything alive, and this is probably this tree at its best. I have a full picture of it that i took a day or two ago, I'll post it when I get home.

Here is a picture of the tree last weekend. It got frosted pretty heavy the 2 nights prior, so it may have lost a little of its color

It's Acer rubrum - Red maple. I can't help you anymore though. There are some die hard tree folks on here that may be able to narrow it down to a cultivar.

In the meantime you may look at the bark lower on the tree to see if you can see a clearly distinguishable change in the bark. If you can find that 'line' you'll know you have a grafted cultivar or if you cannot find a change in the bark you'll know you have a seedling. There are times that grafted trees are difficult to see evidence of a graft, however... but you have (2) trees to look at. Usually the graft is six to eight inches up but could be lower or slightly higher.
